Why would you support Kerry if you are against mass arrests? Despite the fact that this massive violation of civil liberties and interference with free political expression happened DAYS ago Kerry has not yet condemned the police actions. There is no reason to believe that the Kerry that voted for the PATRIOT USA Act, the Kerry that voted for Iraq/Afghanistan, the Kerry that comes from a Democratic Party that oversaw mass arrests at THEIR convention in LosAngeles2000 (70 Critical Mass riders arrested out of 250, a crowd a RageAgainstTheMachine concert shot with teargas, and "non-lethal" rounds) will be any better.

Kerry would do just the same as Bush. He's said it again and again. I believe him.

We need solidarity: solidarity against Kerry AND Bush.

Upcoming Hearing re: $470,000 Fine Against NYC for 8/31 Arrestees
There will be a hearing in the next few days for a final ruling on
Judge Cataldo's ruling that the City be fined $1,000 for each person
detained as of 9/2/04 at 5:00pm who had been arrested 8/31/04. There
were approximately 470 arrestees from 8/31 who were still detained.
The NLG and the People's Law Collective are collecting information

protestors arrested during the RNC who need legal assistance as how
to provide necessary information. For questions not addressed by the

Talking About Your Case
The NLG strongly advises people who were arrested during the RNC to
not talk and to not write about the specific circumstances of their
arrest if they have pending cases, without first speaking with a
lawyer. This applies to the particular acts just before and during
the arrest. Please be aware that statements made on the Internet, as
well as videos/photos shared or posted, reside in the public domain,
and are not private or privileged; they may be viewed by law
enforcement. The NLG recommends having such material reviewed by a
lawyer before making it public. Be aware that if you are talking to
the media, posting emails, having phone conversations about your case
or otherwise publicly speaking about your arrest or the arrests of
others, you are potentially sharing that information with the police.
It may result in problems if you have a pending case. If you assume
the government may monitor telephone and email communications, even
if the government's action may be illegal, you will better protect
yourself and others.

While you may want to comment on how you were treated after your
arrest (e.g., experiences in custody, conditions at Pier 57, the
length of custody until arraignment or release on a DAT), be sure to
note and save what you say or write; if future statements differ,
your prior statements may return to haunt you.

If You Have Been Arraigned and Have An Attorney
People who were arrested and charged with misdemeanors or felonies
were represented at arraignment by an attorney from one of the
following: Legal Aid Society, 18-b panel (private attorneys paid by
the state), or the NLG. You were also given a new court date.

directions on how to provide this information to the NLG.

If You Have Retained A Private Attorney
If you use a private attorney, please contact the NLG at
 nycmassdefense@riseup.net so that the lawyers can coordinate their
efforts regarding possible witnesses and other evidence.

If You Received a DAT and Need an Attorney
People who were only charged with Disorderly Conduct, issued a DAT
with a court date, and who need information about having an attorney
for the upcoming arraignment, should go to www.nlgnyc.org/RNC.html
for directions beginning September 9.

Going to Court
All hearings following arraignment are held at the Criminal Court
Building, 100 Centre Street, in Manhattan. Be sure to carefully
read your DAT slip. Some arraignments are held at other locations,
such as Midtown Manhattan Community Court.

Medical Issues
If you were injured during the RNC protests, go to a medical facility
right away and have your injuries documented on paper and by photo
(make sure you keep the name of the person taking the photo, their
contact information, the date, time and place - digital cameras with
time and date notations on the photo are great). If you cannot go to
a medical facility, have a friend take photos of your injuries or
take them yourself. It is important to document your injuries over
time, e.g., darkening discoloration of bruises over time. Safeguard
the originals of your documentation and email a summary to
 nycmassdefense@riseup.net. The summary should include your name,
address, phone number, docket or arrest number, and a brief
description--date, time, location and what happened to cause the
injury.

Evidence Collection
Beginning September 9, download police misconduct forms from
www.nlgnyc.org/RNC.html and return them to the NLG.

Gather evidence such as videos, photographs, etc. Collect and
safeguard the names and addresses and statements of witnesses who can
testify about the circumstances of your arrest. Forward a brief
summary to  nycmassdefense@riseup.net

Document and safeguard everything you remember ASAP. Make sure your
lawyer has all information related to your case. If you prepare
documentation of the circumstances of your arrest and/or injury at
your lawyer's request, do not give it to anyone or you may destroy
privileges that protect the document.

Civil Suits
NLG lawyers are reviewing possible claims arising from RNC protest
arrests and detentions that may become the basis of civil lawsuits.
If you are considering a civil suit in state court for damages, you
will need to file a Notice of Claim with the City to protect your
right to seek damages under state law. You have 90 days from the date
of your arrest to file. (See www.nycplc.mahost.org/claim.htm for
more information. The NLG recommends consulting with a lawyer before
filing, especially if you have a pending criminal case, but further
recommends marking your calendar 80 days after your arrest as a
reminder. The NLG will be posting more information later this month
on the website--www.nlgnyc.org/RNC.html--about the specifics for
filing a civil claim. If you do file a notice, please send a copy of

Anyone know what happened or is happening to those who were taken into custody on the floor of the convention, particularly the two or more arrested during Bush's speech? I'm a reporter for The Capital Times in Madison, Wis. and traveled with a group who protested the convention.

From what I observed on TV there were many concerted and planned attempts to disrupt the proceedings. Cameras on the streets revealed some very ugly protest tactics. I think if people go into the situation intending to violate the law and do so, then arrest or restraint seems appropriate. I also have ovserved no such behavior during the democratic convention.
